Welcome to FitnessPrimer. These Terms of Service ("Terms") govern your use of the FitnessPrimer mobile application and website (collectively, the "Service") operated by FitnessPrimer ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 13 years old (or 16 in the EEA) and agree to comply with these Terms. If you do not agree, do not use the Service.

2. Description of Service

FitnessPrimer provides AI-powered fitness coaching, including personalized workout plans, exercise form analysis, nutrition guidance, and progress tracking. The Service is intended for informational and educational purposes only.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized use of your account.

4. Health and Fitness Disclaimer

The Service does not provide medical advice. All content, including AI-generated workout plans, form analysis, and nutrition suggestions, is for general informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.

  • Consult your physician before beginning any exercise program, especially if you have pre-existing health conditions.
  • You exercise at your own risk. FitnessPrimer is not liable for any injuries, health issues, or damages resulting from your use of the Service.
  • AI-generated form analysis is assistive and may not detect all form errors. Always prioritize how your body feels and seek professional guidance when in doubt.

5. Subscriptions and Payments

  • Some features require a paid subscription. Pricing and plans are displayed within the app.
  • Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
  • Payments are processed through the Apple App Store or Google Play Store and are subject to their respective terms.
  • Refunds are handled in accordance with the policies of the applicable app store.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to reverse-engineer, decompile, or disassemble the Service.
  • Interfere with or disrupt the Service or its servers.
  • Upload malicious code or content.
  • Impersonate another person or entity.
  • Use automated systems (bots, scrapers) to access the Service without permission.
  • Share your account credentials with others or allow multiple people to use a single account.

7. Intellectual Property

All content, features, and functionality of the Service — including text, graphics, logos, icons, images, software, and AI models — are owned by FitnessPrimer and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

8. User Content

  • You retain ownership of content you submit (e.g., workout logs, photos, feedback).
  • By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and display it as necessary to provide the Service.
  • We may anonymize and aggregate user data for research and product improvement purposes.

9. Termination

We may suspend or terminate your account at our discretion if you violate these Terms or engage in conduct that we determine is harmful to the Service or other users. You may delete your account at any time through the app settings or by contacting us.

10. Limitation of Liability

To the maximum extent permitted by law, FitnessPrimer and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless FitnessPrimer from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the app or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
